What does the civil-remedies paragraph actually preserve?

Usually it leaves the parties to pursue whatever civil rights the law otherwise permits. Read it with the whole order. A finding that cheating ingredients are absent is different from a finding that no money was advanced, and a settlement recorded as fully performed differs from an unresolved accounting dispute.

Make a note of what the criminal court decided and what it expressly left open. Do not quote a favourable sentence while omitting a release, payment acknowledgment or condition elsewhere in the order. The civil lawyer needs the settlement and pleadings as well as the final judgment.

Why can money still be due if there was no cheating?

Failure to prove a criminal ingredient does not necessarily answer a contractual obligation. Illustration (g) to section 318 BNS distinguishes obtaining money with dishonest intention from initially intending performance and later breaking the contract, which can leave a civil breach claim.

Indian Oil Corporation v NEPC India also explains that facts may disclose a civil wrong, a criminal offence or both. That judgment did not quash every prosecution as civil: it allowed some criminal allegations to proceed. Its relevance here is the distinction between the two legal inquiries, not a shortcut to recovery for either side.

Does limitation restart on the quashing date?

Do not assume that it does. A general reservation of civil remedies is not a fresh loan, a new due date or an automatic extension of limitation. Identify the applicable Limitation Act provision and the original cause of action. The correct start can differ between types of money claim and contractual terms.

Section 9 says that once time begins to run, a later disability or inability ordinarily does not stop it, subject to the statutory framework. Section 14 concerns qualifying earlier civil proceedings pursued diligently and in good faith before a court unable to entertain them for jurisdictional or similar reasons. Time spent pursuing a criminal complaint is not automatically excluded under that provision.

If the quashing order contains a specific direction about time, show it to the lawyer. Do not replace that analysis with the general statement that the judge "gave liberty" to sue.

What documents can change the limitation calculation?

A valid acknowledgment or qualifying part payment can matter, but the date and statutory conditions are essential. Section 18 addresses a signed written acknowledgment made before the prescribed period expires. Section 19 addresses qualifying payment before expiry and its written acknowledgment requirements. A late conversation or your own demand letter does not automatically restart the clock.

Give the lawyer every relevant email, signed balance confirmation, repayment entry and settlement proposal, including documents you think are unhelpful. Keep the original date and surrounding correspondence. Whether a particular message amounts to an acknowledgment is a legal question about its actual wording and authority.

What if the case ended on a full-and-final settlement?

Read what was released and whether the agreed performance occurred. A claimant should not demand the same amount again while hiding a payment or discharge. A defendant should not assume that a promise to pay is proof that the promised money was received.

What should each side do next?

The claimant should obtain an immediate limitation and forum assessment, with the amount calculated after all credits. The defendant should preserve the quashing order and settlement but respond to any civil notice or summons on its own deadline. Neither side should treat the criminal result as deciding an issue the court expressly left open.

A civil claim asks a court to enforce a right or grant relief, such as payment or an injunction. A criminal case concerns conduct punishable as an offence. One transaction can raise both questions, but a broken agreement alone does not prove cheating. A relative cannot simply sign the deceased complainant's name or replace their consent without explaining the legal basis. Tell the court about the death and identify whether the deceased was the actual victim and who now has authority to act. For a compoundable offence, section 359(4)(b) BNSS specifically permits the deceased competent person's legal representative to compound with the court's consent. A pending High Court settlement-quashing petition requires its own assessment and directions.

Can an FIR be quashed, and does having anticipatory bail help?

Yes, the High Court can intervene where continuing a criminal case would abuse the court process or defeat justice. Section 528 BNSS preserves that power. Bail and quashing serve different purposes: bail concerns liberty, while quashing asks the court to end the proceedings. A bail order does not itself establish grounds for quashing. Have the FIR, supporting documents and any settlement assessed together before deciding whether this is the right application.

The complainant now wants to withdraw. Can the case simply be closed?

A complainant changing their mind does not automatically close a criminal case. Some offences can be compounded under Section 359 BNSS, with court permission where required. Other cases may need a lawful withdrawal by the prosecutor or an appropriate High Court order. Which route is available depends on the offence and the stage of proceedings. Put any settlement in writing and obtain the necessary court order. An informal promise to stop attending is not a closure order.

My FIR was quashed but a background report still says the case is pending. What should I send the screening company?

Send the screening company the complete quashing order, the exact report entry you dispute and enough case identifiers to connect the two. Ask it to correct the current status and issue an updated report to the employer. Do not describe a settlement quashing as an acquittal after trial or claim that the FIR never existed. A correction request should state precisely what the court ended and for whom.
