Do not sign a receipt stating that originals were returned when they were lost. Ask HR to acknowledge the documents it received, what is missing and the steps it will take to help obtain replacements. A dispute about a training bond does not make an inaccurate return receipt true. Preserve proof of custody and actual loss before discussing a settlement or release.
What should the acknowledgment actually say?
Name each missing document, its issuing institution and any identifying number available from your copy. Record when it was handed over and to whom. If HR admits that the file was misplaced, request that statement in writing with the company's proposed search and replacement process. Avoid a vague note saying only that an employee document issue remains.
If some documents have been returned, acknowledge only those items after checking them. Distinguish an original from a photocopy, scanned copy or duplicate certificate. A form listing every original as returned should be corrected before you sign it. Keep a copy of the corrected acknowledgment and the covering correspondence.
What legal responsibility may arise from custody?
Where the arrangement amounts to bailment, section 151 of the Contract Act sets the standard of care expected of the person holding the goods. Section 152 addresses responsibility for loss where that care has been taken, subject to a special contract. Loss does not therefore justify inventing an automatic fixed compensation figure without examining custody, care and the agreement.
Sections 160 and 161 concern return when the agreed time ends or purpose is accomplished, and responsibility where failure to return at the proper time is the bailee's fault. Give the adviser the deposit receipt, purpose of collection, return requests and admission of loss. Those facts help distinguish negligent custody from a dispute about whether HR ever received the originals.
Does Karnataka have a specific rule on originals?
The September 2026 amendment inserted section 6-C into the Karnataka Shops and Commercial Establishments Act. It prohibits covered employers from retaining original educational certificates, experience certificates or other original employee documents at appointment or during employment. The same amendment inserted a service-certificate duty under section 6-B.
Coverage must be checked. The amendment also added an exemption for establishments employing ten or more workers if already registered under the Occupational Safety, Health and Working Conditions Code. Do not apply section 6-C indiscriminately to every workplace in India or every establishment in Karnataka. A loss or retention that occurred earlier also needs its dates assessed rather than treating the new provision as a retrospective penalty.
How do I document the actual loss?
Ask the issuing university or board for its duplicate-document procedure, required declarations, fees and expected processing steps. Preserve the response and receipts for reasonable replacement expenses. If a new employer or educational institution needs the original, ask what temporary verified record it will accept and retain the deadline communication.
Do not file a false statement saying you personally lost a document at home if the known fact is that it was lost in the employer's custody. Explain the accurate circumstances in any required declaration or report. Ask HR to provide an authorised letter supporting the replacement request where appropriate.
Can I settle the bond and the missing documents together?
They can be addressed in one carefully drafted settlement, but identify the obligations separately. State any agreed bond payment, the documents still missing, the employer's assistance and reimbursement obligations, and the position if an original is later found. Avoid an unexplained full-and-final clause that says every document has already been returned.
A useful response is: "I can acknowledge receipt of the items actually returned. The originals listed below remain missing according to your communication of [date]. Please correct the receipt and confirm the replacement assistance and costs proposed, without treating this acknowledgment as settlement of the separate bond dispute." Have any broad release checked before signing.
If HR refuses to record the loss, preserve the correspondence and take advice on the appropriate employment or civil remedy. The next step should be directed at proving custody, obtaining usable replacements and addressing the actual loss. A general accusation posted publicly is less useful than a precise file showing what was entrusted and what happened to it.
