How do I get the khata transferred to my name after buying a flat in Bengaluru?

Check whether the registered purchase has already generated a mutation in the municipal system. If it has not, use the applicable khata transfer process and keep the sale deed, existing property number and tax records ready. The Bengaluru eKhata portal provides an automatic-mutation status service and lists documents for final eKhata. Match the owner's name, flat number and property details carefully. Updating the municipal record is separate from the registered sale that transfers ownership.

Registration of the sale deed makes you the owner. It does not, by itself, change the municipal record. Those are two separate systems, maintained by two separate authorities, and the second does not update because the first did. A khata is the municipal account of a property recording who is liable to pay tax on it, together with its extent and location. It is evidence of the tax liability, not of ownership. A khata in your name does not prove title, and a khata still in the seller's name does not undo your registered sale deed.

Why it matters even though it is not title

Because everything downstream asks for it. A building plan sanction, a trade licence, a water or electricity connection in your name, a home loan against the property, and the next sale all run through the khata. If the property sits in the B register, the transfer will also surface that, and what to do about it is covered in our guide to B khata to A khata conversion. Leaving it in the seller's name is not a legal risk to your ownership so much as a practical block on using what you own.

What to file

  • The registered sale deed, original for verification and a copy to file
  • The previous owner's khata certificate and khata extract
  • The latest property tax paid receipt, with no arrears outstanding
  • An Encumbrance Certificate covering the period up to the sale
  • The title flow, where the property has changed hands more than once
  • Identity and address proof, and a passport photograph
  • The occupancy certificate and approved plan, for an apartment
  • The allotment or possession letter from the builder, where relevant
  • A no-objection from the association or builder, where the format requires it
Clear the arrears first
An application filed while tax is outstanding will not move, and the arrears attach to the property rather than to the person who ran them up. Check the tax position on the portal before you complete the purchase, not when you come to file the transfer.

The sequence

  1. Confirm the tax account is clear and that the property identifier matches the deed.
  2. File the transfer application with the documents above, and keep the acknowledgement.
  3. Pay the transfer fee, which is calculated on the consideration recorded in the deed.
  4. Site inspection and scrutiny, where the authority verifies extent and dimensions against the record.
  5. The record is updated and the certificate and extract issue in your name.
  6. Verify the digitised record afterwards, because errors in extent and spelling surface at exactly this stage.
A purchaser completes in March and does not file the transfer, on the view that the sale deed is what matters. In November he applies for a loan against the property and is asked for a khata in his name. He now discovers that the seller's tax account carries arrears from two earlier years, and that the extent in the municipal record is 60 square feet less than the deed says. Both are fixable. Both are far harder to fix eight months later, with the seller uncontactable and no leverage left. File the transfer in the same month you register.

If the builder has not handed over the khata

An apartment purchaser often cannot file at all, because the khata for the project has never been created or bifurcated into individual units. That is a separate problem with a separate remedy against the promoter, dealt with in the builder delay answer and on the property practice page.

The seller says it is a B khata property. What does that mean for me?

A B record signals a municipal recording issue that needs investigation before purchase. It does not cure missing planning approvals or establish ownership. Ask exactly why the property is in that category and obtain the supporting land, layout and building records. The official framework sets conditions for obtaining A-Khata status. Do not accept a promise that conversion will happen after you pay. Have the present status and any proposed corrective steps checked against the current official requirements.

The sub-registrar refused to register my sale deed because there is no e-khata. What do I do?

Ask for a written refusal and the precise document the registrar says is missing. Section 71 of the Registration Act generally requires recorded reasons for refusing registration. A refusal on grounds other than denial of execution can be appealed to the Registrar within thirty days. Meanwhile, check the final eKhata process and your property's record with the responsible municipal office. An oral statement at the counter is not enough to assess the legal position or protect an appeal deadline.

I have a B khata property. Can I get an e-khata, and does that make it an A khata?

An eKhata is an electronic property record. Getting one does not, by itself, turn a B record into an A record. The citizen portal asks separately for documents supporting A-Khata status, and A-Khata eligibility requires separate checks. Check what category the final record actually shows, whether your property qualifies and which approvals are missing. Keep the sale deed, tax record and approval documents together. A digital certificate should not replace an examination of the property's title and permissions.

The builder has not given possession of my flat. Is that a consumer case or RERA?

If the promoter misses the agreed possession obligation, RERA provides remedies that differ according to whether you withdraw or stay in the project. A qualifying homebuyer may also have a consumer remedy for deficient housing services. Gather the agreement, payment records, promised date and the promoter's explanation for delay. Decide whether you want possession or a refund before choosing the claim. Disclose any existing proceedings and amounts received so that the remedies are coordinated and the same loss is not recovered twice.

My name is spelled wrong in the registered sale deed. How is that corrected?

For a genuine spelling mistake, the parties can usually execute and register a rectification deed recording the intended name. Compare the sale deed with identity documents first, so the correction does not change who actually bought the property. If the other party refuses, Section 26 of the Specific Relief Act allows a court to rectify an instrument affected by fraud or mutual mistake, subject to its conditions. Keep copies of the original and corrected deeds for later property records and loan checks.

What should I actually verify before buying a flat or site in Bangalore?

Before paying an advance, ask for the title documents and follow how the seller acquired the property. Check the registered transactions, approved layout or building plan, land-use position and any existing loan. For a covered development, compare the promoter's promises with the RERA disclosures and agreed completion dates. The seller's duty to disclose material defects does not replace your own checks. Have mismatched names, boundaries and missing approvals resolved before the payment timetable puts you under pressure.
