No automatic punishment follows from calling a screenshot forged. Section 14(2) concerns a committee conclusion that a witness gave false evidence or produced a forged or misleading document. The committee can recommend action to the witness's employer or the District Officer, as applicable, under the applicable service rules or prescribed procedure. Ask to see the precise allegation, the material said to establish falsity and the proposed process before giving your response.
Am I accused of fabrication or of making a mistake?
Get that distinction recorded. A screenshot may be incomplete, wrongly dated, forwarded by someone else, compressed by an application or actually fabricated. Those explanations have different factual implications. A finding that the document is unreliable does not itself explain who altered it or what the witness represented about it.
If you supplied a forwarded image, say so. If you created the screenshot from your own device, identify the application, approximate extraction date and whether anything was cropped. Do not now describe a forwarded file as your own original merely because the original sender is unavailable. The provenance is part of your answer.
What does section 14(2) allow?
It specifically addresses a witness giving false evidence or producing a forged or misleading document during the inquiry. It permits a recommendation to the employer of the witness to take action in accordance with service rules, or in the prescribed manner where no such rules exist. This is different from treating the committee as a criminal court that can convict and sentence you for forgery.
The provision also differs from section 14(1), which deals with malicious or knowingly false complaints and specified documents from the woman or another person making the complaint. The Act expressly says inability to substantiate a complaint does not by itself attract action against the complainant. Do not confuse a failed allegation, witness credibility and deliberate documentary falsity.
What should my response contain?
Answer the identified document and statement, not the personalities involved. Ask for the version the committee received, the allegedly authentic comparison record and the particular alteration alleged. If the employer's server copy is relied on, request a fair opportunity to understand and respond to it. Natural justice under Rule 7 matters to the process.
Your response can say: "I supplied the image on [date] as a file received from [source], not as a screenshot independently taken by me. Please identify the alteration alleged and provide the material relied on. I request an opportunity to explain the file's origin before any recommendation under section 14(2)." Use this only if it accurately describes what occurred.
Preserve the original file, the message through which you received it and relevant device records. Do not edit the file to make the date or name more legible and overwrite the original. Supply a clearly labelled working copy if an enlarged image is needed. A later improvement must not masquerade as the original evidence.
Does an allegation against me settle the original complaint?
No. The committee must still assess the original complaint on the remaining material and explain what weight it gives the disputed evidence. One unreliable screenshot does not automatically prove that every witness lied. Conversely, a serious original allegation does not excuse manufacturing supporting material.
A witness who discovers an error should correct it promptly in writing. Identify the earlier statement, the correction and why it is necessary. Honest correction may be relevant, but do not promise yourself immunity or assume that deleting the image from a chat removes it from the inquiry record.
What if a recommendation has already been made?
Obtain the report, the recommendation concerning you and the employer's notice or proposed action. Section 18 expressly includes recommendations under section 14(2) within its appeal framework and states a ninety-day period. The competent forum depends on the applicable service rules and statutory route, so have the documents checked promptly rather than sending an informal protest and assuming the clock has stopped.
If a separate police allegation is made, obtain advice on that process separately. The committee recommendation and a criminal investigation have different legal consequences. Do not contact the complainant or other witnesses to coordinate accounts. Your strongest immediate response is an accurate source history for the file and a written request for a fair opportunity to answer the specific charge.
