An ex parte divorce decree can be challenged, but the next filing depends on why you were absent, how summons was served and whether an appeal has already been decided. Obtain the decree, judgment, complete order sheet and service papers immediately. A challenge under Order IX Rule 13 CPC ordinarily goes to the court that passed the decree, while an appeal addresses a different set of questions.

Write down the first date you actually learned of the decree and preserve the message, letter or court record through which you learned it. Article 123 of the Limitation Act ordinarily provides thirty days, running from the decree or, where summons or notice was not duly served, from knowledge of the decree. Do not assume every person who says they were unaware receives a fresh thirty days.
Deadline warning. The knowledge date is a fact to prove, not a date to choose. Ask for an immediate limitation assessment even if the decree is old or a certified copy is still awaited.
What should I collect after discovering an ex parte divorce decree?
Collect the procedural record before deciding that the decree was obtained fraudulently. A decree made without your participation may involve defective service, a genuine inability to attend, a missed communication with counsel or deliberate non-appearance. Each requires a different factual explanation.
Ask for the petition and annexures, summons, process-server reports, postal records, applications for substituted service, the order allowing publication, the newspaper page, the order proceeding ex parte, depositions, judgment and decree. If electronic service was directed, collect the actual direction and the delivery material relied on. Do not assume a screenshot held by your spouse is the complete service record.
Prepare a parallel personal chronology: where you lived during the relevant period, when you received any notice, what you understood it to concern, whether you engaged an advocate, and why you could not appear on the hearing date. Supporting documents might include tenancy records, travel records or hospital records. Preserve them in their original form.
The first consultation should produce a route and deadline assessment, not a promise that every ex parte decree is easily cancelled. The first documents serve different purposes:
Decree and judgment
Identify what the court actually granted and why, including the marriage law, findings, dates and any separate financial or child-related direction.
Service record
Check addresses, attempted delivery, the substituted-service order and the evidence on which the court decided that notice was sufficient.
Your chronology
Connect actual knowledge and absence to dated documents. An unsupported assertion that you never knew may not answer the court's record.
Which court can set aside the decree?
Under Order IX Rule 13 of the Code of Civil Procedure, 1908, the application is made to the court which passed the ex parte decree. The principal grounds are that summons was not duly served or that sufficient cause prevented appearance when the case was called for hearing.
For civil matrimonial proceedings, the CPC operates through the governing marriage law and Section 10 of the Family Courts Act, 1984, subject to the relevant provisions and rules. A case in a Family Court and one before another competent matrimonial court require attention to the court's actual jurisdiction and local procedure.
A setting-aside application is not the same as asking the court to reconsider whether every allegation of cruelty was proved. Its immediate focus is the reason the decree was entered without your participation. If the real complaint is that the judge misread the evidence despite proper service, an appellate route may be more appropriate. The two routes have different limits and can interact.
Do not send a general complaint to a court registry and assume it is a filed application. A proper filing, affidavit, requested relief and compliance with procedural requirements are needed. Keep the filing acknowledgement and clear registry objections promptly. A draft on your laptop does not protect a deadline.
When does the thirty-day period start?
Article 123 distinguishes the date of decree from knowledge where summons or notice was not duly served. Its explanation also says substituted service under Order V Rule 20 is not deemed due service for this article. That specific limitation rule should not be confused with saying every newspaper-service decree is invalid.
The Limitation Act's Article 123 must be applied to the service facts and the actual date of knowledge. A court may disbelieve a late claimed knowledge date if another case, letter or admission shows you knew earlier. Collect those potentially adverse records too.
If the application is late on the applicable calculation, ask about a Section 5 request to condone delay with a complete explanation. The court must be satisfied about sufficient cause. Do not merely attach a sentence that delay was neither intentional nor deliberate and leave long periods unexplained.
Applying for certified copies is sensible, but do not assume every day spent obtaining them is automatically excluded for this particular application. Section 12 contains specific exclusions for identified proceedings. An advocate should calculate the deadline for the actual remedy rather than importing the appeal calculation into every setting-aside request.
Prepare a date table including decree, alleged service, actual knowledge, copy application, copy availability, consultation and filing. This makes disputes about time visible before a pleading is sworn. It also helps distinguish a delay in discovering the case from a later delay in acting after discovery.
What counts as defective service?
The answer comes from the service method authorised, the steps actually taken and the CPC requirements. A wrong address, an unexplained postal endorsement or a publication order made without the required foundation may matter. A minor irregularity does not always justify reopening the decree.
The second proviso to Order IX Rule 13 says the decree shall not be set aside merely for irregularity in service if the court is satisfied that the defendant had notice of the hearing date and sufficient time to appear and answer the claim. That exception is a major reason to avoid the claim that no personally signed acknowledgement always means no valid decree.
Read the documents together. If the petitioner supplied an old address while communicating with you at a known current address, preserve those communications. If the process server says a family member accepted delivery, examine who that person was, where delivery occurred and what the applicable service rule required. Do not assume that a relative's involvement necessarily invalidates service.
For publication, obtain the judicial order authorising substituted service and its recorded basis. Order V Rule 20 contemplates judicial satisfaction about avoidance of service or inability to serve ordinarily. The newspaper's circulation and the location chosen can also matter. Your application should identify the precise defect and supporting record rather than simply expressing surprise that a newspaper notice existed.
Electronic delivery requires equal care. A message on a number you no longer used may raise one issue, while a delivered notice which you discussed with your spouse raises another. Preserve the full exchange. Deleting it will not improve the service argument and may damage credibility.
What if I knew about the hearing but could not attend?
Then the application may need to establish sufficient cause for absence rather than deny knowledge. Give a clear account of the relevant hearing date, what prevented appearance and what steps you took once able to act.
A serious illness supported by contemporaneous records is different from a vague statement that you were under stress. If hospitalised, identify admission and discharge dates and the actual restriction on participation or communication. If the problem concerned counsel, obtain the relevant communications and explain what you reasonably understood was being done.
Do not assume that blaming an advocate automatically succeeds. Courts assess the facts, the party's conduct and the explanation for the missed hearing. A litigant who knowingly stopped following the case may face a different assessment from one who repeatedly sought updates and was incorrectly assured that appearance was arranged.
If a remote appearance or adjournment had been requested, attach the application and the order. A request that was refused cannot be described as permission to stay away. Equally, if an order was not communicated to you, show how and when you discovered it.
The explanation should remain proportionate. There is usually no need to reproduce every marital disagreement to explain why you missed a particular date. Put the legally relevant absence facts first, with the necessary record attached. The underlying defence can be described without turning the application into an unfocused second divorce petition.

Should I appeal as well as seek to set it aside?
Ask for a coordinated remedy assessment before filing either. An appeal and an Order IX Rule 13 application are not interchangeable, and the CPC explanation creates an important interaction once an appeal has been disposed of.
Order IX Rule 13 says that where an appeal against the ex parte decree has been disposed of on a ground other than withdrawal of the appeal, an application under that rule shall not lie. A litigant should therefore disclose every existing appeal and its status to the advocate advising on setting aside. Do not instruct different lawyers on separate routes while withholding the other filing.
The availability and limitation of a matrimonial appeal depend on the governing statute, the court and binding local decisions. Section 19 of the Family Courts Act and Section 28 HMA contain different statutory period language. This article does not supply a universal safe waiting period. Obtain advice immediately and work to the earliest potentially applicable deadline while the legal position is checked.

If the court rejects the setting-aside application, a further challenge may be available under the applicable appellate framework. Obtain the reasoned rejection order promptly. The proper route is a new procedural assessment, not simply refiling the same application with more emphatic language.
Does filing a challenge suspend the divorce decree?
Do not assume the decree is suspended merely because an application or appeal has been lodged. Ask expressly what interim protection is needed and which court can grant it.
The appropriate request might concern implementation of financial directions, preservation of a disputed position or another identified consequence. A general demand to stop everything may be less useful than a prayer explaining the actual threatened act and why interim relief is necessary. Provide the decree and evidence of that urgency.
Remarriage requires particular caution. Section 15 HMA addresses when divorced parties may marry again, and the effect of pending or delayed challenges can be legally complicated. Neither side should rely on a social-media announcement or a case-status screenshot as conclusive advice. Show the decree, appeal information, dates and interim orders to an advocate before taking a position.
If the other spouse has already remarried, disclose it with the source of your information. That fact does not permit a writer to pronounce the restoration application automatically dead or automatically successful. It may affect parties, relief and the court's assessment. The underlying service and limitation questions still require careful analysis.
Common mistake. Treating the filing receipt as a stay order. Keep the application acknowledgement, but separately obtain and read any interim direction actually passed.
What should the affidavit say without overclaiming fraud?
State the facts you personally know and identify the records from which other facts are drawn. If you allege deliberate concealment or false service, explain the conduct and evidence rather than using fraud as a substitute for particulars.
A useful affidavit sequence is: your identity and role, details of the decree, the first knowledge event, your address and service history, the reason for non-appearance, action taken after knowledge, any explanation for delay, and the specific relief requested. Separate disputed facts from conclusions offered on legal advice.
Where a process-server report appears wrong, state why. If it describes you receiving a summons in Bengaluru on a date when you were abroad, attach reliable travel records. If your signature is disputed, identify the document and preserve authentic comparison material. Do not circulate accusations against court staff or the other party online while the issue is being examined.
Any allegation you later withdraw may still have consequences for credibility. A careful statement that the recorded recipient was not authorised or that the address was no longer occupied is more useful than an accusation of conspiracy unsupported by evidence.
The affidavit should also disclose previous appearances and proceedings honestly. If you attended an earlier hearing, say so and explain the later absence. If you knew of the petition but not of the decree, distinguish those dates. They are legally and factually different events.
What if my spouse died after obtaining the decree?
The challenge may still survive because the decree can affect your marital status and property rights. The Supreme Court in Yallawwa v Shantavva, decided on 8 October 1996 distinguished a pending personal divorce claim from an aggrieved spouse's challenge to an already granted divorce decree.
In that judgment, death after the decree did not extinguish the surviving spouse's right to challenge it by the appropriate appeal or setting-aside application. The deceased spouse's heirs or legal representatives could be joined where they had an interest in supporting the decree. The judgment does not remove the need to establish grounds or address limitation.
If the decree is set aside after the petitioner's death, the restored personal divorce claim cannot simply continue as though that spouse were alive. That distinction matters because the purpose of the surviving challenge may be to determine status and consequential rights, not to resume a marriage with a deceased person.
Collect the death certificate, decree and details of any estate, pension or succession dispute in which status is being relied on. Avoid making a categorical inheritance calculation before the marital-status position is resolved. A nomination, benefit rule or will may raise additional questions independent of the divorce challenge.
What happens if the court sets the decree aside?
Ordinarily the underlying proceeding returns for adjudication, subject to the court's order and any event such as death affecting survival. Setting aside does not itself decide that the petitioner can never obtain divorce.
Read any conditions concerning costs, deposits, filing the defence or the next hearing. If the court grants relief on terms, comply within the specified time or promptly seek a permissible extension with reasons. Do not lose the restored opportunity by ignoring the new timetable.
Prepare the substantive response now. Identify what allegations are admitted, denied or require proof, and gather the evidence necessary for the defence or any properly maintainable counterclaim. Restoration is an opportunity to be heard, not a substitute for answering the case.
Check the effect on other directions expressly. Maintenance, child arrangements and orders in separate proceedings may not all move together with the divorce decree. Prepare a list of operative orders and ask the competent court for clarification or variation where required.
A useful restoration record has two short, distinct chronologies. One explains notice and absence. The other explains the marriage dispute. Keeping the first clear prevents the legal reason for reopening the case from being buried under years of accusations.
After any restoration order, confirm these steps:
Order conditions
Read costs, deposits and filing deadlines. A favourable order may impose requirements that must be completed before the case progresses.
Substantive defence
Prepare the substantive reply and evidence. Reopening the case does not determine whether the pleaded divorce ground will ultimately succeed.
Other orders
List support, child and protective directions separately, then obtain any clarification needed instead of assuming all orders changed together.
What should I do today if the deadline is close?
Give an advocate the available record and chronology immediately, while requesting missing certified papers in parallel. Tell them about every previous appearance, appeal and possible knowledge date, including inconvenient ones.
- Verify the case number and obtain the signed judgment and decree.
- Preserve proof of when you learned of the decree.
- Request the entire service record and order sheet.
- Calculate limitation for each realistically available remedy.
- Prepare any delay application and the evidence supporting it.
- Ask expressly about interim relief and the interaction with any appeal.
- File through the proper process and promptly cure objections.
No fixed nationwide cost or completion time can be promised. A short dispute over a clear service defect and a contested application requiring evidence can take very different courses. Seek a fee scope covering record inspection, the main application, any delay or interim request and the possibility of further proceedings.
Keep a simple case folder with the filed version, acknowledgement, orders and next dates. Do not rely only on messages saying the matter is under process. The practical objective is to put the right legal question before the right court in time, with a record that explains why you were not heard.
Keep a record of every attempt to obtain the file, including the copy application number and the dates on which documents became available. These records can help explain the practical sequence after discovery. They do not automatically excuse delay, but they allow the court to assess what you actually did instead of relying on a vague statement that obtaining papers took time. If another lawyer previously held the file, request the complete papers and preserve that correspondence too.
