People often arrive expecting mental agony to be the centre of the claim. It is real, it is compensable, and it is almost never where the money is.
What Section 39 actually allows
Section 39(1) of the Consumer Protection Act, 2019 lists what a commission may order once it is satisfied that the goods are defective, or the allegations about the services or unfair trade practice are proved. The list is wide and it is worth knowing in full, because complainants routinely ask for one relief when four are available.
- Remove the defect, or replace the goods with new goods of similar description free from defect
- Return the price or charges paid, with such interest as may be decided
- Pay compensation for any loss or injury suffered due to the negligence of the opposite party, with an express proviso giving the commission power to grant punitive damages in such circumstances as it deems fit
- Remove the deficiency in the service
- Discontinue the unfair or restrictive trade practice and not repeat it
- Issue a corrective advertisement to neutralise a misleading one, at the advertiser's cost
- Provide adequate costs to the parties
Mental agony sits inside the compensation head as loss or injury. The punitive damages proviso is separate and is the provision to invoke where the conduct is not merely careless but high handed.
How to make the claim land
Quantify everything that can be quantified, and keep agony as the residual head rather than the headline.
- The price paid, with the invoice and the payment proof
- Interest from the date of payment, pleaded as a rate and a period
- Consequential expenditure: alternative accommodation, replacement hire, repeat travel, medical bills
- Documented correspondence showing how long you were made to chase, which is what converts inconvenience into something a commission can measure
- Costs of the proceeding

Reported awards vary enormously between commissions and between fact patterns, and no honest answer gives you a tariff. Anyone quoting a standard figure for mental agony is describing their own experience of a few matters, not a rule. Treat costs and timelines as indicative ranges and get your own matter valued on its documents.
