My bank approved the loan but the RERA website shows no recent progress updates. What should I request before disbursement?

Section 11 requires specified quarterly project disclosures, so request the missing update and milestone evidence in writing. Preserve the official page and compare the records with the demand. Missing updates do not automatically suspend your sale-agreement payments or EMIs, which require separate contractual and legal assessment. A missing quarterly update is a reason to demand current project information, but it does not automatically cancel your instalment or home-loan obligations. Section 11(1) requires the promoter's RERA webpage to carry specified quarterly updates. Obtain the missing records and compare them with the construction-linked demand before deciding how to respond.

What should the promoter update?

The statutory list includes apartments or plots booked, garages booked, approvals obtained and pending after commencement, and project status. It also covers other information and documents specified by the Authority's regulations.

Save the official project page with the date and identify the exact missing quarter or field. A screenshot showing a blank page is more useful when accompanied by the project registration number and the date it was accessed. Check whether the information is available in another official tab before alleging total non-disclosure.

Can I ask for the sanctioned plans and work schedule?

Section 11(3) requires the promoter at booking and allotment to make available sanctioned plans and specifications and the stage-wise time schedule of completion, including the stated civic infrastructure. Section 19 also gives allottees information rights within its terms.

Request the documents relevant to the current payment milestone. If the demand is linked to completion of a slab or another stage, ask what record establishes that stage. A generic assurance that work is progressing does not answer a specific discrepancy between the demand and the available project information.

Does a missing update prove construction has stopped?

No. It proves an information gap if the required update is absent, not necessarily the physical state of the site. Distinguish the disclosure breach from the construction allegation. Collect current, lawfully obtained site information and the promoter's written explanation.

Avoid circulating an old photograph as proof of today's progress. Record when and where photographs were taken and which part of the project they show. A tower-specific demand should not be evaluated using an unrelated block's progress picture.

Should I tell the bank not to disburse?

Notify the lender accurately about the identified discrepancy and ask it to apply its own disbursement conditions and verification process. Take the loan agreement, builder demand and project records for advice before instructing a stop that could have contractual consequences.

Do not assume RERA's website-update duty automatically suspends EMIs or authorises unilateral non-payment. Your loan and sale agreement may impose separate obligations. The adviser should assess the appropriate written response and any protective relief needed if the demand appears unsupported.

What can a complaint ask for?

A section 31 complaint can identify the alleged disclosure contravention and request appropriate directions within the Authority's powers. State the missing information, earlier requests and why it matters to the payment demand. If an inquiry or document production is needed, explain that specifically.

Do not inflate the complaint into a claim that every missing quarter entitles you to immediate refund. The remedy must follow the actual breach and legal basis. If delay or another substantive default also exists, set it out with separate evidence.

What should I send today?

Send a short request identifying the project, quarter, missing fields and disputed milestone. Attach the demand and ask for the current approvals, stage schedule and evidence supporting the demand. Keep proof of delivery and any reply.

Prepare a payment-decision file with the agreement's milestone clause, the lender's conditions and the current project records. That allows the adviser to distinguish a late website update from an unsupported payment demand and choose a response that protects your position without creating an unnecessary default.

The builder has not given possession of my flat. Is that a consumer case or RERA?

If the promoter misses the agreed possession obligation, RERA provides remedies that differ according to whether you withdraw or stay in the project. A qualifying homebuyer may also have a consumer remedy for deficient housing services. Gather the agreement, payment records, promised date and the promoter's explanation for delay. Decide whether you want possession or a refund before choosing the claim. Disclose any existing proceedings and amounts received so that the remedies are coordinated and the same loss is not recovered twice.

My Bengaluru builder has delayed possession. Can I file at RERA from abroad?

Living abroad does not, by itself, prevent a RERA complaint. The Act allows an aggrieved person to complain and permits legal representation. For qualifying possession delay, section 18 distinguishes withdrawing and seeking refund with interest and compensation from staying in the project and claiming delay interest. Start with the possession promise in your agreement, payment records and the builder's communications. Decide the relief you want, then use the applicable Karnataka process and the appropriate forum. A representative can help, but the documents still need to establish the claim.

The builder replaced my booked corner apartment with another unit. Is my consent needed?

Ask for the original and revised plans before accepting a substitute unit. Section 14(2)(i) ordinarily requires your previous consent for specified changes to the unit agreed to be taken, subject to limited minor-change exceptions. The separate two-thirds project-consent rule is not a blanket answer to an individual-unit substitution. A different unit position, outlook or dimension is not obviously minor, so do not accept that label.

The landowner says only the developer is responsible for the flat sold from the landowner share. Is that enough?

A landowner-share sale needs examination of the seller's actual role and documents. Under section 2(zk), a different constructor or developer and seller may both be deemed promoters and jointly liable for the specified RERA responsibilities. Land ownership alone is not a substitute for that analysis, so preserve the development, allocation and sale chain.

I bought a shop, not a home. Can I still complain to RERA?

RERA is not confined to residential flats. Its apartment definition includes shops and offices, and an eligible commercial allottee can invoke applicable RERA rights. Check the project, transaction and breach. A tenant or a separate financial investment arrangement may need different analysis, and consumer-forum eligibility is a separate question. Section 2(e) expressly includes shops, offices and showrooms within the apartment definition.

I Am a RERA-Registered Agent in Karnataka. Can I Use That Number for a Project in Another State?

A RERA agent registration is granted for the relevant State or Union territory, not automatically for all India. Check the other State's requirements before facilitating a covered sale there. Keep the promoter's project number distinct from your own agent registration and verify the person or entity actually conducting the work.
