Before facilitating a covered sale in another State, check the registration required from that State's Authority and the identity in which you will conduct the transaction.
Does single registration mean I need one for every project?
The central provision describes one registration for the State or Union territory, not a separate agent registration for each project there. That must be distinguished from the promoter's project registration. The project number and your agent number perform different functions.
If you operate through several offices within one State, identify the registered person or entity and comply with the applicable disclosure and registration conditions. Do not assume that a branch name, franchise or separate company is automatically covered by a registration issued to someone else.
What if I work online from Bengaluru?
The place where you sit does not answer every question about facilitating a transaction in a project located elsewhere. Identify the project, promoter, buyer, your role and the State's applicable requirements. An online introduction or negotiation may still be relevant to the statutory agent definition.
Section 2(zm) includes specified introductions through any medium for the stated remuneration or fees. Do not assume a video call or a referral payment is outside the framework merely because you never visit the site. Equally, assess the actual activity rather than treating every passive website advertisement as an identical agency arrangement.
Can I use the developer's registration number instead?
No, a project's registration does not establish your compliance with the agent-registration requirement. Section 9(5) provides for the agent's registration number to be quoted in every sale facilitated under the Act. Ask the developer to identify the correct project information, while keeping your own registration separately verified.
The same distinction applies where another broker invites you to work under their number. Examine who is contracting, receiving commission and actually facilitating the sale. A private referral arrangement should not be assumed to transfer a statutory registration from one person to another.
What should I check before accepting the instruction?
Obtain the project details, your proposed role, commission agreement and the relevant Authority's current agent-registration requirements. Check the registration holder's legal name, territory, validity and conditions. Keep the official search result and application or renewal records.
Fees, forms, validity periods and renewal requirements depend on the prescribed rules. Do not copy Karnataka figures into another State's application. If a registration is pending, do not treat submission of a form as proof that you may already operate unless the applicable legal position has been checked.
What if I already facilitated the booking?
Preserve the chronology, communications, fee records and registration position on the relevant dates. Obtain advice on corrective steps and any exposure under the Act. A later registration should not be described as retrospectively curing every earlier act.
Section 62 supplies consequences for contravention of sections 9 and 10. The precise breach and response need assessment. Do not tell the buyer that their transaction is automatically cancelled or that every commission must automatically be refunded merely because a registration issue has emerged.
What should my compliance file contain?
Maintain a State-wise list of the registrations held by the person or entity doing the work, the projects handled and the documents supporting each engagement. Confirm the number that will appear in transaction records before work begins.
The practical decision is territorial and personal: which Authority's registration is needed, who holds it and what activity it covers. That is more reliable than assuming that one valid number can be copied into every booking form across India.
