Which part of my claim is statutory?

Identify the wage period, agreed remuneration, amount paid and amount withheld. A minimum-wage shortfall, unlawful deduction or unpaid wage may engage the Code's claim provisions. A dispute over an optional performance award, share grant or contractual damages may require a different analysis. One employment relationship can produce more than one kind of claim.

Section 45 allows the appropriate government to appoint authorities to decide claims arising under the Code. Section 57 restricts civil suits for specified sums recoverable through that framework, while section 60 prevents contracting out of monetary rights under the Code to the extent stated. These provisions must be considered before accepting a contract clause as the exclusive route.

Does that mean my entire arbitration clause is void?

No. The answer is claim-specific. A statutory wage remedy and the validity or scope of an arbitration clause are not identical questions. A clause may still matter for a separate arbitrable contractual dispute. Avoid writing that every employment arbitration agreement is invalid, or that every monetary claim can be filed before the wage authority.

Read the clause for the parties, disputes covered, seat, appointment process and any prior notice requirement. Then ask counsel to compare it with the statutory cause of action. The classification should be based on the entitlement you are actually asserting, not on changing the label from salary to damages to reach a preferred forum.

What if the company has already started arbitration?

Preserve the notice and record its receipt date. Obtain advice promptly about responding and raising the appropriate jurisdiction objection. A belief that the wage authority is available does not justify silently ignoring another proceeding. The response should explain the statutory nature of the identified claim while addressing the actual notice received.

Disclose any existing wage complaint, arbitration filing or settlement to your adviser. Parallel proceedings can create questions about overlapping amounts and relief. Do not seek double recovery or present different wage figures without an explanation. A single reconciliation should support the factual account in every forum.

What evidence should accompany the forum assessment?

Provide the signed employment contract, amendments, arbitration clause, wage slips, bank credits and the demand for payment. Include the employer's response directing you to arbitration and any notice from an arbitrator or institution. The exact wording matters more than a colleague's summary of what HR normally does.

Prepare a table with each component, its amount, legal source and documents. For example, an admitted monthly salary withheld for an alleged loss should be separated from a contested target incentive. Mark any deduction authorisation and whether the employer disputes payment, entitlement or both. Those distinctions help identify the authority's statutory role.

What is the next practical step?

Ask the appropriate labour office to identify the notified authority and procedure for a Code claim concerning your establishment. The relevant government depends on section 2(d), not simply the place where the employer's registered office is located. The central and State procedural arrangements should not be assumed identical.

Section 45 ordinarily permits a claim within three years from when it arises, subject to sufficient cause for delay. Keep separate track of any arbitration response date or contractual notice issue. A longer statutory claim period does not mean every other deadline can be ignored.

Your written position can say: "The demand concerns wages payable for the identified period under the statutory framework. Please explain the basis for treating the arbitration clause as excluding that remedy and provide the payment and deduction calculation." Have the final filing and jurisdiction position checked against the complete contract and claim. The purpose is to preserve the proper remedy, not to assume one forum resolves every employment dispute.

What counts as wages under the Code on Wages for PF and gratuity?

The Code's wage definition starts with remuneration payable under the employment terms and expressly includes basic pay, dearness allowance and retaining allowance. It then lists exclusions, with an add-back rule for specified excluded components above the statutory proportion. It is inaccurate to treat every allowance as excluded for every purpose. Ask payroll for a component-by-component calculation and the purpose for which it is being used. A payslip label alone does not settle the statutory wage figure.

Your employer cannot assume that transferring cryptocurrency discharges an ordinary statutory wage obligation. Section 15 of the Code on Wages specifies payment in currency, by cheque, through a bank credit or by electronic mode, and the proposed token arrangement needs to be tested against that framework. Ask for your agreed rupee wages to be paid through a compliant payment method and keep the token proposal separate. A voluntary investment or additional token award raises different contractual and tax questions.

Ask HR for an itemised statement showing salary, deductions, leave, gratuity and any contractual payment separately. An exit dispute does not give an employer unrestricted power to withhold wages: the Code on Wages limits deductions and provides a claim procedure. Keep your appointment letter, payslips, resignation and bank statements. Ask for the relieving letter separately. The correct recovery route depends on the particular amount owed. Provident fund, gratuity and a contractual incentive are not the same claim.

My employer restructured my salary to cut PF. Is that still legal under the codes?

Moving salary into allowances does not automatically reduce the legal wage base. The labour codes contain an add-back rule for specified exclusions, but provident fund liability also depends on coverage, applicable schemes and contribution rules. Do not assume that every employee's contribution must equal a fixed percentage of total CTC. Compare your old and new payslips and ask payroll to explain both the wage definition and the contribution calculation. A reduction in agreed pay raises a separate contractual issue.

First identify the minimum-wage notification covering your job, location and employment period. Karnataka does not have one figure that answers every worker's claim, and the Central Government fixes rates for some establishments. Compare the applicable rate with the legally relevant pay components and your records of work. If there is a shortfall, the Code on Wages provides a claim route. Keep payslips and bank credits, and check the filing deadline instead of letting repeated payroll assurances consume the available time.

I resigned and my employer insists on a three month notice period. Can they?

A three-month notice clause can have contractual consequences, but it does not ordinarily allow an employer to force you to keep working. Check whether the agreement permits notice pay, an agreed early release or deductions, and how the amount is calculated. A stipulated sum is subject to the rules on reasonable compensation, rather than being automatically payable in every dispute. Put any agreed shortening of notice in writing and keep the handover record before your access to work systems ends.
