Send the complete quashing order to the Regional Passport Office and the police unit responsible for the verification, linked to your passport application and exact criminal-case references. Ask which record still shows a pending case and request correction or re-verification as appropriate. Check that the order actually covers you and that no separate proceeding or travel restriction remains. A stale police entry and a formal passport refusal require different responses.
Which references should my correction file contain?
Put the passport file number, application date, adverse-report or notice reference, FIR number, police station and court case number on the first page. Attach the full order and current court status where available. Explain any different spelling, accused number or transferred case number so the officer can match the records.
Retain the notice envelope or electronic receipt and note its response deadline. If the RPO asks you to explain a particular pending case, answer that reference directly. Sending an unrelated acquittal order or a general declaration of innocence leaves the verification problem unresolved.
Why contact both the RPO and police?
The passport authority needs the corrected position for its application decision, while the underlying police entry may also need updating. Ask the RPO which clarification or fresh report it requires and submit the judicial outcome to the named verification unit. Use the procedure actually available for your file rather than assuming that every office accepts the same form.
A suggested request is: "The adverse report refers to [case]. The enclosed order dated [date] quashes [specified proceeding] against me. Please verify the operative paragraphs, update the recorded status and arrange any necessary re-verification. Please identify any separate case or outstanding order that remains a concern." Keep acknowledgements from both recipients.
Does the pending-case refusal ground still apply?
Section 6(2)(f) of the Passports Act concerns proceedings pending before a criminal court in India. Where the only cited proceeding has actually ended against you, the decision should be assessed on that corrected factual position. But quashing one proceeding does not establish that every other statutory refusal ground is absent.
Section 6(2)(g) separately addresses court warrants, summons and departure-prohibition orders. For an existing passport, section 10(3) contains its own grounds for impounding or revocation. If there was an earlier passport order, obtain it and ask what further decision is required after quashing. Do not infer that the physical passport's presence in your hand settles its legal status.
What if only another accused obtained quashing?
Then that order may not resolve the report against you. Read the names and operative scope. In Rahul v State of Uttar Pradesh, for example, the Supreme Court expressly limited relief to the appellant. Supply an accurate explanation if your own case remains pending instead of asking the RPO to treat another person's result as yours.
Also identify any later stay, reversal or other order that affects your outcome. A case-status screenshot is useful supporting material, but an unexplained mismatch should be resolved against the actual judicial record. Ask the court registry or lawyer handling the case to obtain the appropriate record or clarification.
What changes if the passport was formally refused or impounded?
Obtain the decision and the reasons, rather than treating the matter as only a police-data correction. Sections 5(3) and 10(5) provide reason-recording and copy-on-demand rules for the specified decisions, subject to their exceptions. A request to update a record is not a substitute for challenging an adverse order within the applicable time.
Section 11 provides appeals against specified passport-authority orders and excludes an appeal under that section against an order made by the Central Government itself. Show the dated decision to a lawyer promptly to identify the applicable appeal period, forum and any other remedy. A pending representation does not automatically preserve the challenge deadline.
Should I omit the old case from a fresh application?
Answer the exact questions truthfully, with the outcome explained where relevant. A question about present pendency differs from one about past arrest or proceedings. Section 10(3)(b) addresses passports obtained through suppression or wrong information. Correcting a stale entry should not create a new disclosure problem.
