Obtain the full suspension or revocation order and the service record immediately. Section 9(7) permits action against an agent's registration on the stated grounds, but its proviso requires an opportunity of being heard before suspension or revocation. A complaint from a buyer is not itself a substitute for that opportunity.
What grounds can the Authority rely on?
The provision addresses breach of registration conditions or other specified statutory terms and registration secured through misrepresentation or fraud. Identify which ground the order actually invokes and which documents support it. A vague portal status saying suspended may not explain the case you need to answer.
Do not assume that every disagreement over commission proves registration fraud. Conversely, a genuine discrepancy in the application cannot be answered merely by showing that some clients were satisfied. Match your response to the particular ground and evidence.
Was notice sent to an address I stopped using?
Check the registered email, postal address, portal communications and any update you submitted. An allegation that you never personally read the notice is different from proof that no lawful opportunity was given. Obtain the dispatch and service details before making that assertion.
If the Authority used an incorrect address despite a properly recorded update, preserve both the update acknowledgment and the notice record. If you failed to update your details, disclose that fact to the adviser. A candid chronology is more useful than an absolute denial contradicted by the portal.
What should I do if a hearing opportunity was missed?
Seek prompt advice on the proper application or appeal and explain the reason for non-participation with evidence. Section 9(7)'s safeguard does not mean that an agent may ignore repeated notices and later insist no decision could be made.
Do not assume a request for reconsideration automatically stops an appeal deadline. Section 44 provides the appeal framework, generally within sixty days from receipt of the order copy with sufficient-cause provision for delay. Preserve the receipt date and ask for a written deadline calculation.
Can I continue working while I challenge the order?
Do not assume the challenge itself restores the registration. Obtain advice on interim relief and the actual effect of any order passed. A pending appeal and an operative stay are different things.
Identify ongoing transactions and communicate accurately about your registration status. Do not continue quoting the number as active if the operative order suspends it. At the same time, do not tell clients that every completed transaction has automatically become void: that is a separate legal question.
Which documents should accompany the challenge?
Collect the registration and conditions, application disclosures, show-cause notice, service records, your response, hearing communications and final order. Add the documents addressing the alleged breach and any corrective step already taken.
A useful comparison has three columns: allegation, Authority's finding and your document-based answer. If the complaint included a forged approval number, for example, identify the number you actually supplied and its source. Do not answer a specific factual allegation only with a general statement that the business is reputable.
What outcome should I request?
The appropriate request may concern a hearing, reconsideration within lawful powers, setting aside the order or interim protection, depending on the forum and defect. Explain the relief and legal basis rather than simply asking that the portal be switched back on.
The immediate task is to establish whether the required opportunity was given and whether the finding is supported. Protect the challenge timetable while addressing the actual alleged breach. That gives the reviewing forum both the procedural issue and the evidence needed to decide what should happen to the registration.
