An ordinary tenant is expressly excluded from RERA's allottee definition. If your dispute is return of a rental security deposit, do not assume that the building's RERA registration gives you the allottee complaint route. Identify the rental agreement, the person holding the deposit and the appropriate remedy under the law governing that tenancy and claim.
Why does registration of the building not settle my rights?
Project registration concerns the real estate project and its statutory framework. It does not convert every occupier into an allottee. Section 2(d) includes specified allotment, sale and transfer transactions but excludes a person to whom the property is given on rent.
A tenant may have enforceable contractual or other rights, but those rights should be pursued on their proper basis. Describing yourself as a homebuyer when the document is a rental agreement can create an unnecessary standing dispute.
What if the agreement uses the word lease?
Read the transaction rather than the label alone. The definition recognises a sale whether freehold or leasehold, while excluding property given on rent. A qualifying acquisition of leasehold property and ordinary rental occupation are therefore not automatically the same thing.
Examine the rights transferred, term, consideration, title documents and the parties' obligations. Do not assume that a long term or large deposit by itself turns a tenancy into an allotment. If the arrangement is unusual, obtain advice on its legal character before choosing a forum.
What evidence should I preserve for the deposit claim?
Keep the rental agreement, deposit payment proof, rent statements, exit notice, handover record and communications about deductions. Photograph the condition of the premises lawfully and retain meter readings or other records relevant to the claimed charges.
Ask for an itemised explanation of deductions with supporting bills or contractual provisions. A dispute about damage, unpaid charges or notice period needs those details. Keep your own calculation accurate, including any admitted amount due.
Who should receive the demand?
Identify the person or entity that received the deposit and the contractual obligation to return it. A property manager, broker and owner may have different roles. Do not automatically demand payment from the developer merely because it constructed the building.
If ownership or management changed, preserve the assignment or communication explaining who assumed the deposit obligation. Your demand should address the actual debtor and state the amount, handover date and basis for return.
Can I use RERA for a different project complaint?
The fact that a tenant is excluded from allottee status does not answer every possible regulatory complaint by an aggrieved person under section 31. But a private rent-deposit dispute is not transformed into a promoter breach merely by referring to that broader phrase.
Identify the exact RERA contravention if there is a separate issue. Do not use it as a substitute for analysing the tenancy claim. The adviser should distinguish information given to a regulator from a forum's power to award the particular deposit refund sought.
What should I do now?
Send a factual deposit demand with the agreement, payment and handover details, and request the basis for each deduction. Obtain advice on the applicable State tenancy or civil recovery framework and any contractual dispute-resolution clause. This answer does not prescribe a single nationwide rent-deposit forum.
Keep limitation and costs in view without waiting for repeated informal promises. The useful first decision is whether your document records rental occupation or a qualifying property acquisition. Once that is clear, the claim can be directed to a forum with power to grant the remedy you actually need.
