DIFC Unit Access Blocked: Can You Withhold Service Charges?

A blocked access door does not automatically entitle a DIFC unit owner to stop paying service charges. In Oana v Onyx, the court rejected that link because the payment obligation under the particular agreement and management statement was independent of the unit's immediate usefulness for retail letting. The access complaint and the service-charge liability needed separate legal foundations.

Start by identifying what the access documents promise and what the service-charge documents require. Then decide how each dispute should be pursued. This guide concerns an owner's DIFC property dispute. It is not advice about withholding a residential tenant's rent or applying mainland Dubai property procedures.

Why does the blocked door not answer the payment question?

The commercial impact may be serious. An owner may say that customers cannot enter conveniently, a prospective tenant has withdrawn or the unit cannot serve its intended purpose. Those facts deserve examination, but they do not by themselves explain why an existing service-charge obligation has stopped.

Service charges may fund common-property management and maintenance rather than buy a guaranteed level of income from the individual unit. The contractual and statutory basis of the levy therefore needs to be read separately from the alleged access promise.

Ask three questions. What payment obligation is asserted? What access obligation is alleged to have been breached? What legal provision or contractual term is said to connect that breach to a right to withhold payment? The third question is often missing from correspondence that simply says no access, no charges.

This separation does not concede that every demand is correct or that the access problem is acceptable. It makes the challenge more precise. A calculation error in the charges and an alleged failure to provide access can coexist without being the same legal issue.

What did Oana v Onyx decide?

Oana v Onyx [2025] DIFC SCT 101, issued on 14 August 2025, is a refusal of permission to appeal. It should not be presented as a new trial judgment resolving every possible property right.

The owner argued that sealing a door undermined the retail unit's viability and justified withholding service charges. The court examined the agreement and management statement relied on in that dispute. At paragraphs 10-15, it found that the charges were independent of the unit's immediate functionality or ability to be leased.

The court also found that the agreement did not provide the exact access-door functionality asserted, and that the owner had not established a material breach justifying the withholding. Those findings depend on the documents and arguments in that case. They do not establish that all access restrictions are lawful.

At paragraphs 16-17, the court rejected the requested reclassification of the unit from retail to commercial as outside the claimant's contractual obligations. The fact that a different classification might make a unit easier to let did not create a contractual duty to provide it.

Permission to appeal was dismissed. The order made no costs order for that application. Do not confuse that outcome with a statement that the underlying service charges were cancelled, that the door had to reopen or that every owner must bear every charge irrespective of its validity.

Key takeaway. Oana rejected a particular withholding defence. An owner who disputes access still needs to identify the source of the access right and the proper route for relief.

What should I check in a service-charge demand?

The official March 2022 Strata Title Law consolidation, Article 68, addresses annual service-charge levies, budget approval, allocation and payment notices. It provides a statutory structure to examine alongside the applicable management statement and agreement.

Under that text, the body corporate manager prepares the annual budget for submission to the Registrar before levying charges. Allocation ordinarily follows lot entitlements, subject to the specified exceptions and the separate principal-scheme provisions. It is therefore useful to ask which scheme and allocation basis the demand uses.

Article 68 also requires at least thirty days' notice of the amount and due date. Check the actual notice and its delivery record. Do not assume that an invoice total proves the procedural requirements were met, or that a possible defect automatically eliminates the underlying liability permanently.

For late-payment interest, identify the applicable resolution, rate and approval. Article 68(8) requires a fair and reasonable rate fixed by ordinary resolution and approved by the Registrar. A charge labelled interest should not be accepted or rejected without checking its basis.

There is a source-status limitation. The official legal database links the March 2022 consolidation while its detail page labels the underlying law record Inactive. That label alone does not establish repeal. The currently operative text and amendments must be authoritatively confirmed before publication or reliance in a live matter. The statutory discussion here identifies the supplied text, not a completed currency certification.

How do I prove the access right rather than only the inconvenience?

Locate the sale agreement, registered plans, strata management statement, relevant by-laws and any documented access arrangement. Identify exactly which route is affected. A general description of a well-connected retail location is different from a specific obligation to keep a named door open at identified times.

Preserve the restriction notice and ask who made the decision, when and on what basis. The building manager communicating the decision may not be the person legally responsible for the alleged promise. The appropriate respondent depends on the obligation being pursued, not just on who answered the last email.

Photographs and a dated plan can explain the physical problem. Mark the affected entrance, alternative routes and the unit boundary without altering the original documents. Record operating hours and the practical effect of the restriction. Do not describe a less convenient route as no access at all if another route remains usable.

If safety, security or regulatory reasons are given, obtain the actual written direction where available. Do not defeat a barrier, reopen a sealed door or instruct a contractor to do so without the necessary authority. The legal challenge should address the stated basis through the appropriate process.

For an alleged letting loss, retain the prospective tenant's correspondence and the proposed commercial terms. Distinguish a concluded lease from an inquiry or an agent's estimate. Explain why the access restriction caused the lost opportunity and identify other reasons the letting did not proceed.

Can I challenge charges or seek access without withholding?

The supplied Strata Title Law text provides several forms of relief through the Registrar. Article 98 addresses contraventions of the Law, management statement or by-laws and permits specified orders. Article 111 addresses inadequate or excessive charges and unreasonable payment arrangements. These are distinct questions from whether a door should be open.

Article 104 concerns information or records wrongfully withheld where the applicant is entitled to them. That qualification matters. A request should identify the particular record and the entitlement to inspect it, rather than demand all documents held by the manager.

Other provisions address common-property issues, but the relevant route depends on the property and right involved. Do not assume that one form or one respondent can resolve every dispute. Ask whether relief is sought from the Registrar, through a court claim, or through the contractual dispute process, and verify the applicable procedural requirements.

Payment accompanied by a clear statement of a dispute may be considered as a practical option, but the wording and legal effect require advice. A label such as under protest is not a universal reservation of every right. Equally, withholding without an assessed basis can add a separate arrears dispute to the access problem.

Common mistake. Treating a serious access complaint as an automatic defence to every service-charge demand can leave the owner fighting two disputes instead of obtaining a decision on the right actually needed.

Choose the requested outcome before preparing the evidence.

Identify the budget, approval, allocation or management record needed to test a specific part of the demand and the basis for access to it.

Charge correction

Explain the alleged calculation or approval defect and distinguish it from objections about the commercial performance of your particular unit.

Access restored

Identify the exact route and supporting right, then assess the appropriate respondent and remedy rather than using unpaid charges as the remedy itself.

What should my first response contain?

A focused response should acknowledge the demand without making unnecessary admissions, identify the disputed items and request the records needed to assess them. In a separate section, describe the access restriction and the right you rely on. Keep the requests concrete enough to answer.

  1. Identify the unit, owner, scheme and entity issuing the demand.
  2. Attach a payment reconciliation and list any disputed charge items.
  3. Request the relevant budget, allocation and approval records.
  4. Describe the access restriction with dates and supporting documents.
  5. Identify the relief sought and request a reasoned response.
  6. Check any court response deadline independently of the correspondence.

If proceedings have already been issued, do not treat the request for documents as a substitute for responding to the claim. Read the court notice, identify the applicable deadline and obtain advice on any defence or separate claim. Negotiations do not themselves establish that the court timetable has stopped.

Where the parties are willing to discuss resolution, separate immediate access measures from the accounting dispute. A temporary operational arrangement may be useful without resolving every legal issue. Record its scope and duration so it is not later mistaken for a permanent variation or a full release.

What should be checked before taking the next step?

The final assessment should identify whether the objection is to the levy itself, to the amount, to an alleged breach of an access obligation, or to a combination. State what evidence supports each point and what remains missing.

Keep permission-to-appeal decisions in their proper place. Oana is useful for the independence of the particular service-charge obligation and the limits of the contractual reclassification request. It is not a complete manual for enforcing easements, changing permitted use or calculating lost rent.

Later-history searches located no verified subsequent reversal of this order, but that is a bounded search rather than proof that no later proceeding exists. A live matter should be checked against the current case record and operative property legislation. The fact that the unit is in DIFC should remain explicit throughout, especially when someone supplies guidance written for another Dubai property regime.

A useful result is a short decision note: what is payable or disputed now, which access right is alleged, who must answer it, what remedy is sought and which deadline matters next. That gives the owner a basis for action without promising that commercial inconvenience cancels a separate debt.

Can I reopen a sealed door myself while the dispute continues? Do not alter a disputed access point without checking the required authority and safety approvals. Identify the right you rely on and seek the appropriate remedy instead of creating a further property or safety dispute.
