A prenuptial agreement in India will not be enforced like a decree, but it is far from a wasted exercise. Indian courts have treated a properly drafted, fully disclosed prenup as evidence of what a couple actually intended about money and property, and that evidence can change how a judge reads a later dispute. This article deals with the practical end of it: which clauses to include, how to execute and stamp the document, and where its usefulness stops.

Whether such an agreement is legally binding at all is a separate question, and we covered it in our post on whether prenuptial agreements are valid and enforceable in India. Read that first if you want the doctrine. What follows assumes you already know the position is unsettled and you still want the document done properly, because a carelessly drafted prenup is worse than no prenup at all.

What a Prenuptial Agreement in India Can Realistically Achieve

Begin with the right expectation. A prenup here is a private contract between two people who are about to marry. It is not a matrimonial property regime, because outside Goa, India has no matrimonial property law that divides assets between spouses on divorce. What the document does is create a clear, contemporaneous record of intention, made at a point when neither side was angry, litigating, or hiding anything.

That record does real work in five recurring situations.

Separate property versus jointly built property. Indian courts decide ownership by title and by who actually paid, not by the fact of marriage. Fights get bitter when a flat stands in joint names but only one spouse funded the down payment, or when a spouse's parents paid for a purchase and nobody documented it. A schedule attached to the prenup, listing what each person owned on the wedding day and how future acquisitions will be treated, removes most of that argument. A family business or professional practice. Founders and second generation business owners usually want one thing: that shares in the family company do not get dragged into a matrimonial fight. A prenup cannot override company law or the register of members, but it can record that the shareholding predates the marriage, that the other spouse asserts no claim to it, and that dividends or salary drawn from it are separate income.

Stridhan and wedding gifts. Stridhan is a married woman's absolute property: her jewellery, the gifts she receives at the wedding, cash or articles given by her parents. Recovery disputes are common precisely because nobody made a list at the time. A prenup with a signed, photographed inventory is the cleanest proof available years later. Debts. Personal loans, education loans, a vehicle loan taken in one name for the other's benefit. The agreement can allocate responsibility as between the couple, which matters when one of them later says the other should have paid.

Cross border and NRI situations. Where one spouse holds assets abroad, or the couple intends to live outside India, an agreement that identifies foreign assets and names a governing law and a forum saves a great deal of argument later.

A family court in Mumbai, in an order reported in 2023, put the Indian position about as plainly as it has been put. It declined to uphold a prenuptial agreement as a binding contract, but held that the agreement could be taken into consideration just to understand the intention of the parties. The court relied on Section 14 of the Family Courts Act, 1984, which allows a family court to receive any report, statement or document that in its opinion will assist it to deal effectively with the dispute, whether or not that material would be admissible under ordinary evidence law.

That is the whole practical case for drafting one carefully. The four points below restate what the document is and is not.

Evidence, not a decree

An Indian prenup is not enforced like a court order. Its value is as a contemporaneous record of what the couple intended about property and money before any dispute arose.

Section 14, Family Courts Act

A family court may receive any document that assists it to deal with the dispute, even material ordinary evidence law would exclude. That is the door a prenup walks through.

No property regime

Outside Goa, India has no matrimonial property law dividing assets on divorce. Ownership follows title and actual contribution, not the fact of marriage.

The stridhan inventory

Stridhan is the wife's absolute property. A signed, photographed list annexed to the agreement is the cleanest proof available in a recovery fight years later.

What a Prenuptial Agreement Cannot Do in India

This is the part most drafts get wrong, and it is where prenups collapse.

It cannot take away maintenance. The right to maintenance under Section 125 of the Criminal Procedure Code, now Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023, exists to prevent destitution. Courts have refused to let a private contract extinguish it. The same applies to interim maintenance and permanent alimony under the Hindu Marriage Act, 1955. A clause reciting that the wife waives all claims to maintenance will not be given effect, and its presence can make the entire document look coercive. It cannot decide custody. Custody turns on the welfare of the child as it stands on the date of hearing, not on what two adults agreed before the child existed. A custody clause in a prenup is a statement of hope, nothing more.

It cannot be executed like a decree. If the other side breaches it, there is no execution court to go to. You either sue on it as a contract, which is slow, or, far more commonly, produce it in the matrimonial proceeding and ask the judge to take it into account.

It can be struck down on public policy. Under Section 23 of the Indian Contract Act, 1872, an agreement is void if the court regards its object as opposed to public policy, and Indian courts have long been uneasy about agreements made in contemplation of future separation. Section 10 of the same Act requires free consent, lawful consideration and competent parties, which is exactly why the manner and timing of signing matter so much.

It cannot be used to defeat creditors or conceal assets. Shifting assets onto paper in one spouse's name to keep them away from a bank or a maintenance claim invites a finding of fraud. Judges are alert to concealment, as we discussed in hidden assets in divorce.

Common mistake. Drafting the prenup as a maintenance waiver. The moment a judge reads a clause trying to sign away statutory maintenance, the whole document starts to look like an instrument of pressure rather than a record of intention. Draft maintenance as a floor, a minimum the earning spouse commits to, never as a ceiling and never as a bar.

Clause by Clause: What Goes Into a Workable Indian Prenup

A usable agreement runs to eight or ten pages plus schedules. The following clauses are the ones that earn their place.

Recitals and capacity. Names, ages, the intended date of marriage, the law under which the marriage will be solemnised (Hindu Marriage Act, 1955, or Special Marriage Act, 1954, or personal law), and a statement that both parties are of sound mind, are marrying voluntarily, and have had the opportunity to take independent legal advice.

Schedule of assets and liabilities. Two annexures, one per party, listing immovable property with survey or khata details, bank and demat accounts with the last four digits, shareholdings, jewellery, vehicles, insurance policies, provident fund, and every loan outstanding. Attach supporting documents. This annexure is the spine of the whole agreement.

Separate property clause. Everything in the schedules, plus anything either party later inherits or receives by gift from their own family, remains that party's separate property, and income from it remains separate income.

Jointly acquired property clause. The cleanest formulation is that beneficial ownership in a jointly bought asset follows documented contribution, proved by bank transfers rather than assertion.

Stridhan register. A dated inventory of jewellery and gifts with photographs, valuations where available, and an acknowledgement that stridhan is the wife's absolute property and will be handed over on demand.

Family business shield. Identify the company, the shareholding and the date of acquisition, and record that the other spouse makes no claim on the shares or the goodwill.

Debt allocation. Who services which loan during the marriage and who bears it afterwards. Say plainly that this binds the couple between themselves and does not affect any lender's rights.

Residence and dispute resolution. Where the couple will live, and an agreement to attempt mediation before litigation. Draft the residence clause carefully, because a wife's right to reside in a shared household is a statutory protection that cannot be signed away.

Review clause and severability. A commitment to revisit the schedules every three to five years, and on the birth of a child or a substantial change in either party's finances. Add that if one clause is held void the rest survives, and name Indian law and the courts at your city of residence.

Execution Formalities That Give the Document Weight

Because the agreement lives or dies on how credible it looks, execution matters more here than in an ordinary commercial contract. The sequence below is the one worth following.

  1. Exchange full financial disclosure in writing, well before the wedding date. Annex bank statements, property documents, salary slips and loan statements. Non-disclosure is the easiest ground on which to attack the agreement later.
  2. Have each party take independent legal advice from a different advocate. Record the advocate's name in the agreement and, better still, annex a short certificate from each advocate confirming the advice was given.
  3. Sign at least two to four weeks before the wedding, never on the eve of it and never at the venue. A document signed hours before the ceremony looks like duress.
  4. Execute on stamp paper of the value applicable in your state, with each page initialled by both parties.
  5. Sign before two independent witnesses who are not immediate family of either side, with their full names, addresses and identity document numbers recorded.
  6. Get the agreement notarised. Notarisation does not make it enforceable, but it fixes the date and the identity of the signatories.
  7. For couples where one side is abroad, record a short video of the reading and signing, and keep photographs of the signing table with the annexures visible.
  8. Give each party an original and lodge one set with the advocates. Diarise a review date.

In practice, what we see in Bangalore family courts is that the argument almost never turns on the wording of the clauses. It turns on the circumstances of signing. If the wife was handed a typed agreement two days before the muhurat, was not told what her husband owned, and had no lawyer of her own, the document is treated as worth very little. If both sides disclosed everything, both had separate advocates, and the signing was weeks in advance, the same document is read seriously as evidence of intention. The drafting is the easy half.

Key takeaway. The credibility of a prenup in India rests on three things a judge can verify from the paper itself: full disclosure annexed to the agreement, independent legal advice for each side, and a signing date comfortably before the wedding. Get those three right and the clauses will be read on their merits.

Stamping, Notarisation and Registration

Stamp duty on documents is a State subject, so the rate depends on where you execute. A prenuptial agreement is not a conveyance and does not transfer property, so in most States it falls under the residuary entry for an agreement not otherwise specifically provided for. Duty under that entry is modest, typically in the range of a few hundred to a few thousand rupees, and the correct course is to check the current schedule under your State's stamp law on the day you execute, because these entries are revised. Do not treat any figure quoted on a website as current.

Under-stamping is not fatal in the way people fear, but it is expensive and embarrassing: an insufficiently stamped instrument can be impounded when produced in court, and you then pay the deficit plus a penalty before the court will look at it. Pay the right duty at the outset.

Registration is a different question. A prenuptial agreement as such is not compulsorily registrable. But if a clause actually creates, declares or transfers an interest in immovable property, the Registration Act, 1908, applies to that part, and an unregistered document will not pass title. The safer drafting is to keep the prenup declaratory, recording who owns what, and to execute any actual transfer by a separate registered instrument.

Notarisation is optional and cheap. It proves nothing about enforceability, but it does make it much harder for a party to later claim the signature was fabricated or the date was changed.

Disclosure or nothing

Annex bank statements, property papers and loan statements. Non-disclosure is the easiest ground on which the other side attacks the agreement years later.

Two lawyers, two sides

Each party should take advice from a different advocate, named in the agreement. A single lawyer drafting for both sides weakens the document badly.

Never on the eve

Sign at least two to four weeks before the wedding. A document executed hours before the ceremony reads as duress, whatever it says inside.

Stamp, do not register

Stamp under the residuary agreement entry in your State. Registration is not required unless a clause actually transfers an interest in immovable property.

Goa and Muslim Law: Where Something Like a Prenup Already Exists

Two parts of the Indian system already contain what the rest of the country lacks.

Goa continues to apply the Portuguese Civil Code of 1867, which gives married couples an actual matrimonial property regime. The default position is communion of assets, under which property acquired by either spouse is held jointly, and couples may instead elect a different regime, such as separation of assets, by an ante-nuptial deed executed before the Civil Registrar prior to the marriage. That deed is a true prenuptial contract with statutory backing. It is also the reason Goa is the standard answer whenever anyone asks whether India recognises prenups at all.

Under Muslim personal law, marriage is itself a contract, and the nikahnama routinely carries terms that Indian courts have enforced: the amount and timing of mahr, conditions about residence, and in some cases a delegated right of divorce for the wife. A carefully negotiated nikahnama does much of what a prenup is meant to do, without the public policy problem, because the contractual character of the marriage is built into the personal law rather than imposed on it. Couples marrying under the Special Marriage Act, 1954, and those governed by the Hindu Marriage Act, 1955, have neither of these tools. That is exactly the gap a well drafted prenup is trying to fill, and why its role is evidentiary rather than dispositive.

NRI Couples and Foreign Prenuptial Agreements

A prenup signed in London, Dubai or New Jersey does not automatically travel. An Indian court asked to give effect to it will ask three questions: was it validly made under the law of the place where it was made, does it offend Indian public policy, and does the party resisting it say they were not given a real choice. Indian courts also apply their own tests when a foreign matrimonial order is produced here, which we cover in the validity of a foreign divorce decree in India.

The practical answer for cross border couples is not to rely on one document. Execute a mirror agreement in India, in English, referring to and consistent with the foreign agreement, stamped and notarised here, with the Indian assets scheduled separately. Where the couple is signing in different countries, sign in counterparts with each signature notarised or apostilled locally, and keep the video record. Assets and residence change fast in NRI marriages, so a review clause matters more here than anywhere else. One warning. A prenup is not a substitute for the settlement document that ends a marriage. Frequently Asked Questions

Is a prenuptial agreement legal in India?

There is no law that prohibits signing one, and there is no law that makes it binding either. Courts have declined to enforce prenups as contracts but have been willing to read them as evidence of what the parties intended, which is why drafting and execution quality matters so much.

Can a prenup stop my spouse from claiming maintenance?

No. Maintenance under Section 125 CrPC, now Section 144 BNSS, and under the Hindu Marriage Act, 1955, is a statutory right that cannot be waived by private contract. A clause attempting it is likely to be ignored and may damage the credibility of the rest of the document.

Does a prenuptial agreement have to be registered?

Not as such. It should be executed on stamp paper of the correct value for your State and is usually notarised. Registration becomes relevant only if a clause actually transfers or declares an interest in immovable property.

How much stamp duty applies?

It depends on the State, and the agreement generally falls under the residuary entry for agreements not otherwise provided for, where duty is typically a few hundred to a few thousand rupees. Verify the current entry under your State stamp law before you execute rather than relying on a figure seen online.

Can we sign a prenup after the wedding?

A post-nuptial agreement is possible and is drafted along similar lines, but it faces the same enforceability difficulty and an added one: courts look closely at whether the spouse who gave something up was under pressure inside a marriage that had already started to fail.

Will a prenup protect my family business?

It helps by recording that the shareholding predates the marriage and that the other spouse asserts no claim, but the actual ownership question is decided by company records and the shareholders agreement, not by the prenup. Treat it as one layer of protection among several.

Do we each need our own lawyer?

Yes, and this is not a formality. Independent legal advice for each side is one of the few features a judge can verify from the paper itself, and its absence is the commonest reason a prenup is given no weight.

Is a foreign prenup valid in India?

An Indian court will examine whether it was validly made abroad, whether it offends Indian public policy, and whether consent was genuine. The safer approach for NRI couples is a mirror agreement executed in India covering the Indian assets, consistent with the foreign document.

Can a prenup decide who gets the children?

No. Custody is decided on the welfare of the child at the time of the dispute, and no agreement made before the child was born can bind that discretion.
