Why is a bank credit not enough?

A bank statement shows what reached your account. It may not show the wage period, earnings components, days counted, overtime or deductions used to arrive at that amount. Those details can matter when you challenge a shortfall or need to explain your salary history. A regular net transfer does not make the underlying calculation transparent.

Keep the question precise. If the only current problem is the missing wage slip, say so. Do not allege that no wages were paid when your bank statement proves payment. If a separate deduction is disputed, identify it as a separate issue and request the records needed to understand it.

Which rule applies to my workplace?

Section 50 contains the statutory record and wage-slip duties. The appropriate government is determined under section 2(d), which allocates specified establishments to the central sphere and others to the State sphere. The location of the head office alone does not decide the question. Ask payroll which statutory procedure it follows.

The final Code on Wages (Central) Rules, 2026 were published in May 2026. Rule 52 prescribes electronic or physical Form V on or before payment. Rule 51 also addresses prescribed records and their preservation. Do not present that central form as the compulsory form for every State establishment without checking its applicable rules and any transitional arrangements.

Is a small employer automatically exempt?

No general exemption follows simply from having a small office. Section 50(4) makes a specific exception for an employer to the extent that no more than five persons are employed for agriculture or domestic purposes. Its definition of domestic purpose concerns the employer's home or family affairs and excludes business or establishment activities.

That exception also preserves an obligation to produce reasonable proof of wage payment when demanded by the Inspector-cum-Facilitator. A business cannot merely call its accounts informal and conclude that it owes no records. Give the adviser the actual work and establishment facts if the employer relies on the exception.

What should I ask payroll to provide?

List the months and request the slips showing the calculation of wages paid. Give your employee identifier and a reliable delivery address. If an online portal is used, ask for restored access or downloadable copies. A portal that ceased working after your exit is a practical access problem worth recording with dated screenshots.

You can write: "I received the bank credits for [months], but have not received the corresponding wage slips. Please issue the slips required under the applicable wage framework, showing the earnings and deductions for each period. Please identify the applicable rule and explain any discrepancy between the slip and the bank credit." Keep the reply and attachments.

What if I need the slips for another employer or a loan?

Explain the deadline, but keep your statement accurate. Ask the recipient whether it will temporarily accept your appointment letter, bank statement or an employer salary certificate while the slips are obtained. Those alternatives may help the immediate transaction, but they are not a reason for the employer to disregard an applicable statutory duty.

Do not create a wage slip yourself using the company's logo or alter an old slip to match the credit. A personal reconciliation should be clearly labelled as your calculation. The distinction protects you if the employer later supplies a different breakdown or the recipient verifies the document.

Where can I raise continued refusal?

Take the written request, response, employment proof and bank records to the appropriate labour office. Section 51 provides the Inspector-cum-Facilitator framework, including inspection and specified record-related powers. Ask which officer has jurisdiction over the establishment and how to lodge the record-compliance complaint.

If the slips reveal unpaid wages or an unlawful deduction, obtain advice on the separate claim and its deadline. The absence of a slip should not be allowed to postpone all action on a known shortfall. Keep a month-by-month chronology so that a records complaint and any monetary claim rest on the same accurate account.

What counts as wages under the Code on Wages for PF and gratuity?

The Code's wage definition starts with remuneration payable under the employment terms and expressly includes basic pay, dearness allowance and retaining allowance. It then lists exclusions, with an add-back rule for specified excluded components above the statutory proportion. It is inaccurate to treat every allowance as excluded for every purpose. Ask payroll for a component-by-component calculation and the purpose for which it is being used. A payslip label alone does not settle the statutory wage figure.

Your employer cannot assume that transferring cryptocurrency discharges an ordinary statutory wage obligation. Section 15 of the Code on Wages specifies payment in currency, by cheque, through a bank credit or by electronic mode, and the proposed token arrangement needs to be tested against that framework. Ask for your agreed rupee wages to be paid through a compliant payment method and keep the token proposal separate. A voluntary investment or additional token award raises different contractual and tax questions.

My employer restructured my salary to cut PF. Is that still legal under the codes?

Moving salary into allowances does not automatically reduce the legal wage base. The labour codes contain an add-back rule for specified exclusions, but provident fund liability also depends on coverage, applicable schemes and contribution rules. Do not assume that every employee's contribution must equal a fixed percentage of total CTC. Compare your old and new payslips and ask payroll to explain both the wage definition and the contribution calculation. A reduction in agreed pay raises a separate contractual issue.

My employer is paying below minimum wage. Where do I complain in Karnataka?

First identify the minimum-wage notification covering your job, location and employment period. Karnataka does not have one figure that answers every worker's claim, and the Central Government fixes rates for some establishments. Compare the applicable rate with the legally relevant pay components and your records of work. If there is a shortfall, the Code on Wages provides a claim route. Keep payslips and bank credits, and check the filing deadline instead of letting repeated payroll assurances consume the available time.

My employment contract says every dispute must go to arbitration. Can I still use a statutory wage remedy?

An arbitration clause does not automatically remove a statutory wage-claim remedy. First separate the amount claimed under the Code on Wages from a purely contractual dispute, such as an additional incentive whose entitlement depends on the contract. Ask the employer to identify why the notified statutory authority allegedly lacks jurisdiction. Do not ignore an arbitration notice, but do not accept the clause as a complete answer to unpaid statutory wages.

I work through a contractor at a client's site. Who is my actual employer?

Start with the staffing agreement and payslips: the contractor normally pays your wages. Where the contract-labour provisions apply, the principal employer must cover unpaid wages if the contractor defaults, and can recover that amount from the contractor. This does not automatically make every outsourced worker a permanent employee of the client company. Keep attendance records, bank credits and messages showing where you worked. Identify both entities accurately before choosing whom to approach for the missing payment.
