A closer look at the matter

Forums, evidence and practical decisions

A loss involving a financial firm may raise a civil claim, a regulatory complaint, or both. Start with the actual entity, product, mandate and loss rather than assuming the regulator will award compensation.

DIFC financial regulator

Dubai Financial Services Authority (DFSA)

Receives information about matters within its regulatory remit. A regulatory complaint does not itself determine a client's civil compensation claim.

Statutory review tribunal

Financial Markets Tribunal (FMT)

Reviews qualifying DFSA decisions through the statutory reference process. It is not the ordinary starting point for an investor's damages claim.

Civil and commercial court

DIFC Court of First Instance

A DIFC jurisdictional gateway or effective written opt-in must be established. A Dubai address alone does not establish jurisdiction.

How to organise the first assessment

  1. 01

Identify the firm, permission and transaction

  2. 02

Separate civil loss from the regulatory concern

  3. 03

Use the proper complaint, court or statutory reference route

Civil remedy
A private claim needs jurisdiction, a cause of action, proof of loss and the appropriate remedy. A disappointing return does not on its own establish actionable mis-selling.
Regulatory complaint
The DFSA receives complaints within its remit and generally expects the concern to be raised with the firm first. It does not provide the complainant with a civil damages judgment.
FMT reference
The FMT reviews qualifying DFSA decisions under its statutory process. Identify the referable decision, standing and applicable time limit. It is not a general forum for an unhappy investor.

Worked examples

These are hypothetical situations, not accounts of the firm's cases or promises of an outcome. The linked guides explain related issues in more detail.

Illustration 01

An investment was sold as low risk but falls sharply

The situation
The investor says oral assurances contradicted the risk disclosures and their agreed objectives.
The route and what matters
Compare the advice, client classification, risk profile and product documents. Separate market loss from loss caused by the alleged breach and identify the appropriate private and regulatory routes.

Illustration 03

A regulatory decision is due to be published

The situation
A regulated person disputes the decision and fears harm from publication before review is complete.
The route and what matters
Read the notice, reference route and applicable publication/privacy tests. Treat a request about publication separately from the merits challenge. An allegation of reputational damage is not an automatic confidentiality entitlement.

Documents worth assembling

  • Client agreement, mandate and applicable firm permissions
  • Product documents, advice and risk-classification records
  • Transaction, payment and loss calculations
  • Complaint response or DFSA decision notice and receipt evidence

Common questions

Will a DFSA complaint recover my investment?

A regulatory complaint is different from a civil compensation claim. Identify the private remedy, forum and limitation separately.

Is the FMT the first forum for a mis-selling claim?

No. Its reference jurisdiction concerns qualifying DFSA decisions. An investor's civil claim requires its own route.

Does a Dubai bank automatically fall within DIFC Court jurisdiction?

No. The entity, transaction, relevant gateway and any effective jurisdiction agreement must be examined.
