Dubai and DIFC forums: who handles what?
Compare 18 courts, specialist divisions, institutions and procedural routes. Some entries sit within the same court system. Their powers and the requirements for using them differ.
Choose the route from the remedy
- 01Identify the parties, agreement, order and relief sought.
- 02Establish jurisdiction and any binding arbitration agreement.
- 03Check the track, statutory prerequisites, service and timing.
- 04Separate the merits claim from urgent protection and enforcement.
Civil and commercial court
DIFC Court of First Instance
A DIFC jurisdictional gateway or effective written opt-in must be established. A Dubai address alone does not establish jurisdiction.
Example of a matter
An unpaid services contract, a guarantee claim or an application for urgent relief.
Appellate court
DIFC Court of Appeal
An available appeal follows the governing law and appeal rules, including permission where required. An SCT appeal has its own route.
Example of a matter
A party challenges a material legal error in a CFI judgment and identifies the order and permission route.
Simplified court track
DIFC Small Claims Tribunal (SCT)
DIFC jurisdiction comes first. Part 53 then governs value, consent, employment and other allocation conditions. Its representation, costs and appeal rules differ from a CFI claim.
Example of a matter
A modest invoice, qualifying employment balance or lease dispute, with the proper jurisdiction and track.
Specialist DIFC division
Technology and Construction Division
Part 56 concerns technically complex claims within DIFC jurisdiction. It does not create a separate right to sue over every Dubai building project.
Example of a matter
A design failure requiring engineering evidence or a disputed software implementation.
Specialist DIFC division
Digital Economy Court
Part 58 addresses suitable digital-economy disputes within the Court's jurisdiction. A digital asset is not by itself a DIFC jurisdiction clause.
Example of a matter
Disputed custody of tokens, platform access or ownership and control of digital assets.
Arbitration institution
Dubai International Arbitration Centre (DIAC)
Administers proceedings under the applicable arbitration agreement and rules. The tribunal decides the merits. The legal seat determines the supervisory court framework.
Example of a matter
A supply or construction contract referring disputes to DIAC arbitration.
Court-support route
DIFC Court arbitration applications
Part 43 governs arbitration claims. The seat, application and relevant law determine the available court powers.
Example of a matter
An appointment issue, a jurisdiction application or recognition of an unpaid award.
Execution route
DIFC enforcement proceedings
Recognition, execution and interim asset protection are different steps. Identify the debtor, the assets and the court with the necessary power.
Example of a matter
A creditor has a judgment but needs asset information or an appropriate execution measure.
DIFC financial regulator
Dubai Financial Services Authority (DFSA)
Receives information about matters within its regulatory remit. A regulatory complaint does not itself determine a client's civil compensation claim.
Example of a matter
Alleged unsuitable advice, misleading product information or misuse of client funds by a regulated business.
Statutory review tribunal
Financial Markets Tribunal (FMT)
Reviews qualifying DFSA decisions through the statutory reference process. It is not the ordinary starting point for an investor's damages claim.
Example of a matter
A regulated firm or individual seeks review of a referable DFSA decision.
Corporate registry
DIFC Registrar of Companies
Incorporation, registration and prescribed filings. A registry update is different from adjudication of a contested shareholder or directors' liability claim.
Example of a matter
A change in company particulars, registration issue or dispute requiring the underlying corporate records.
Specialist court procedure
DIFC insolvency proceedings
Identify the relevant Insolvency Law procedure and applicable court rules. Foreign recognition has its own Schedule 4 framework; it is not simply a winding-up petition under Part 54.
Example of a matter
A winding-up petition or a foreign representative seeking recognition and specified assistance.
Data-protection regulator
DIFC Commissioner of Data Protection
Supervision and enforcement of the DIFC Data Protection Law. Its application must be established before importing rules from another privacy regime.
Example of a matter
A data-access refusal, unlawful disclosure concern or complaint about a covered controller.
Registration service
DIFC Wills Service and Non-Muslim Wills Registry
Registration within the service's eligibility and asset/guardianship rules. Registration during life and probate following death are different processes.
Example of a matter
A person plans for qualifying UAE assets and appoints an executor.
Estate-administration route
DIFC probate proceedings
Part 55 and the applicable wills framework govern the grant, administration and contested issues.
Example of a matter
An executor seeks a grant, or an interested person raises a supported challenge to the will.
Mainland court system
Dubai Courts
First-instance, appeal and cassation courts operate within their statutory jurisdiction. A DIFC case does not move here simply because a party prefers the procedure.
Example of a matter
A mainland commercial or property claim for which no different binding forum applies.
Specialist rental forum
Dubai Rental Disputes Center
Rental disputes within its statutory remit and exclusions. Check DIFC premises, free-zone court arrangements and the actual nature of the agreement.
Example of a matter
A mainland landlord-tenant dispute about rent, possession or the lease, after the jurisdiction check.
Employment complaint and decision process
MOHRE labour complaint route
Relevant to employment within the applicable mainland framework. DIFC employment follows its own statutory and court regime. Other free-zone arrangements require checking.
Example of a matter
An unpaid wage complaint by an employee covered by the mainland labour process.
